Phenix City father charged with murder after 1-month-old's death

A Phenix City, Ala. father has been charged with murder after his 1-month-old son died on Jan. 7, according to police officials.

Patrol officers and EMS workers were dispatched to the child's address between 7:30 a.m. and 8 a.m., after receiving reports that the child was having difficulty breathing, Capt. Frank Ivey told the Ledger Tuesday afternoon. He was pronounced deceased at the Midtown Medical Center.

Ivey declined to release the name of the child. He also refused to give the street address for the child's residence.

"There's a lot of investigating and a lot of evidence that has to be collected before we can comment further," Ivey said.

The cause of death was also not released. Ivey said the child's body appeared to be in "normal condition" when EMS workers arrived, but refused to say whether he was still alive when EMS workers arrived.

His father, 30-year-old Eric Colby Burgess, was arrested Jan. 8 and charged with murder. The child's body has been transported to the Alabama Department of Forensic Science.
