CHAPPELL to MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC. AS NOMINEE FOR AME FINANCIAL CORPORATION dated February 4, 2009, filed for record February 16, 2009, and recorded in Deed Book 09606, Page 228, MUSCOGEE County, Georgia Records, as last transferred to CITIMORTGAGE, INC. by assignment recorded in Deed Book 10429, Page 272, MUSCOGEE County, Georgia Records, said Deed to Secure Debt having been given to secure a Note dated February 4, 2009 in the original principal sum of ONE HUNDRED THIRTY FIVE THOUSAND THREE HUNDRED FORTY AND 0/100 DOLLARS ($135,340.00), with interest from date at the rate stated in said Note on the unpaid balance until paid, there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door at MUSCOGEE County, Georgia, within the legal hours of sale on the first Tuesday in August, 2014, the following described property: ALL THAT TRACT OR PARCEL OF LAND, LYING, SITUATE AND BEING IN MUSCOGEE COUNTY, GEORGIA, BEING ALL OF LOT 21 IN BLOCK B OF BATTLE FOREST SUBDIVISION, PHASE ONE, AS SAME IS SHOWN ON THE SUBDIVISION PLAT RECORDED IN PLAT BOOK 31 FOLIO 10 OF THE MUSCOGEE COUNTY, GEORGIA PLAT RECORDS, AND WHICH PLAT IS HEREBY INCORPORATED BY REFERENCE FOR A MORE COMPLETE DESCRIPTION OF SAID PROPERTY. SAID PROPERTY BEING ALSO KNOWN AS 5201 GETTYSBURG WAY ACCORDING TO THE PRESENT SYSTEM OF NUMBERING PROPERTIES IN MUSCOGEE COUNTY, GEORGIA, AND BEING THE SAME PROPERTY CONVEYED BY WARRANTY DEED DATED OCTOBER 10, 2006, TO CASANOVA CHAPPELL JR. AND INDIA N. CHAPPELL RECORDED IN DEED BOOK 8640 PAGE 65 OF THE MUSCOGEE COUNTY, GEORGIA DEED RECORDS. SAID PROPERTY IS CONVEYED SUBJECT TO ALL RESTRICTIONS, COVENANTS AND EASEMENTS OF RECORD. To the best of the knowledge and belief of the undersigned, the party in possession of the property is CASANOVA CHAPPELL, JR and INDIA N. CHAPPELL or a tenant or tenants. Said property is more commonly known as: 5201 GETTYSBURG WAY, COLUMBUS, GA 31907. The debt secured by said Deed to Secure Debt has been and is hereby declared due because of, among other possible events of default, non-payment of the monthly installments on said loan. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorney's fees (notice of intent to collect attorney's fees having been given).
