NOTICE OF POWER OF SALE CONTAINED IN DEED TO SECURE DEBT AND SECURITY AGREEMENT STATE OF GEORGIA COUNTY OF MUSCOGEE Under and by virtue of the power of sale contained in that certain Deed to Secure Debt and Security Agreement dated October 25, 2013 executed by DENNIS G. NEVILLE, an individual resident of the State of Georgia (ÒMortgagorÓ) and recorded in Book 11096, Page 185, Muscogee County, Georgia records (the ÒSecurity DeedÓ) in favor of SOUTHEAST CANNERS, INC., a Georgia corporation (ÒLenderÓ), as Attorney-in-Fact for Mortgagor, will sell at public outcry to the highest and best bidder for cash, between the legal hours of sale before the Courthouse door of Muscogee County, Georgia, on the first Tuesday in August, 2014 (August 5, 2014), the following described property, to wit (the ÒPropertyÓ): ALL THAT LOT, TRACT OR PARCEL OF LAND situate, lying and being in the City of Columbus, County of Muscogee and State of Georgia and being more particularly described on Exhibit ÒAÓ attached hereto and incorporated herein by this reference (the ÒPropertyÓ). The Security Deed was given to secure that certain Promissory Note dated October 25, 2013 in the original principal amount of ONE MILLION NINE HUNDRED FIFTY-TWO THOUSAND SEVEN HUNDRED NINETY-SEVEN AND 69/100 DOLLARS ($1,952,797.69) made by Mortgagor to the order of Lender (the ÒNoteÓ), with interest thereon as provided in the Note until paid. On account of defaults in the terms of the Note, the Security Deed and other loan documents, including Mortgagor's failure to make regularly scheduled payments when due under the Note, Lender, the present holder of said Security Deed and the Note, has declared the entire unpaid principal balance of all obligations secured by said Security Deed, including interest to date of sale, to be due and payable immediately. The debt remaining in default and unpaid, this sale will be for the purpose of satisfying the principal and interest due, amounts, if any, expended by Lender to protect its interest in the Property, and all expenses of this sale, including, without limitation, attorneys' fees. The Property will be sold subject to outstanding ad valorem taxes and/or assessments, and superior easements, restrictions and rights-of-way and other superior matters of record, if any. The undersigned will execute a deed to the purchaser at the sale as provided in the aforesaid Security Deed.
