NOTICE OF SALE UNDER POWER STATE OF GEORGIA, COUNTY OF MUSCOGEE. Pursuant to a power of sale contained in that certain security deed dated December 20, 2007, recorded in Deed Book 9208, Page 241, in the Office of the Clerk of Superior Court of Muscogee County, Georgia, from ROBERT S. YARBROUGH to PHENIX-GIRARD BANK, securing a note in the original principal amount of $100,000.00 with interest thereon from the date thereof, there will be sold by the undersigned, at public outcry and to the highest bidder, for cash, before the courthouse door in Muscogee County, Georgia, within the legal hours of sale on the first Tuesday, August 5, 2014, the property described in said deed, to-wit: All that lot, tract or parcel of land lying and being Columbus, Muscogee County, Georgia, and being Part of City Lots 617, 618, 619 and 620, being more particularly described as follows: To reach the Point of Beginning, start at a drill hole located at the intersection of the North line of 15th Street with the East line of 4th Avenue, and run thence North 01 degree 40 minutes West along the East line of 4th Avenue a distance of 254.67 feet to a drill hole located at the intersection of the North line of St. John's Alley with the East line of 4th Avenue; run thence North 88 degrees 23 minutes East along the North line of St. John's Alley a distance of 147.0 feet to an iron pin marking the Point of Beginning. From said Point of Beginning, run thence North 01 degree 51-1/2 minutes West a distance of 145.69 feet to an iron pin located on the South line of Zion Alley; thence run North 88 degrees 35-1/2 minutes East along the South line of Zion Alley a distance of 102.91 feet to an iron pin; thence run South 01 degree 54 minutes East a distance of 145.32 feet to an iron pin located on the North line of St. John's Alley; thence run South 88 degrees 23 minutes West a distance of 103.0 feet to the iron pin marking the Point of Beginning.. The above-described property is shown upon a map or plat entitled ÒPart of City Lots 617, 618, 619 and 620, Columbus, Muscogee County, Georgia,Ó dated August 25, 1981, and prepared by Moon, Meeks & Patrick, Inc. The debt secured by said security deed has been and is hereby declared due because of, among other possible events of default, non-payment of principal and interest due under said note and security deed. The debt remaining in default, this sale will be made for the purpose of applying the proceeds of such sale to such debt and all expenses of this sale, including attorney fees. Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessment, lien, encumbrance, zoning ordinance, restriction, covenant and matter of record superior to the security deed first set out above. Notice has been given of intention to collect attorney's fees in accordance with the terms of the note secured by said deed. Said property will be sold as the property of Robert S. Yarbrough. To the best information, knowledge and belief of the undersigned, the property is currently in the possession of Robert S. Yarbrough, and the proceeds of said sale will be applied to the payment of said indebtedness and all the expenses of said sale, including attorney fees, all as provided in said security deed, and the balance, if any, will be distributed as provided by law.
