No ruling on whether a Lee County judge will recuse himself from the Courtney Lockhart case has yet been issued.
The secretary for Circuit Court Judge Jacob A. Walker III said today that no order has been filed in the case against Lockhart, 23. The Smiths Station, Ala., man's attorneys asked the judge at a hearing last week to recuse himself and all Lee County judges from the case because of perceived ties to Auburn University and because Walker's March recitation of the charges against Lockhart could be seen as bias.
Lockhart faces three capital murder charges -- one for each allegation in the March 4 robbery, kidnapping and attempted rape of Lauren Burk, 18. He also faces a fourth, unrelated charge in the robbery of a Short Stop Convenience Store. He has pleaded not guilty to all charges.
