Dustin Ray Horton, the Seale, Ala., man accused of causing the death of a former Lee County Sheriff's deputy Monday outside a Columbus Waffle House will have his first appearance hearing today in Columbus Recorder's Court.
Horton, 21, was arrested at a Russell County home around 11:30 a.m. Monday, said Columbus Police Lt. Charles Kennedy.
He’s accused of causing the death of Scott Jeremy Drago, 36, who was found around 3:10 a.m. Sunday lying 15 feet from his truck in the restaurant’s parking lot at 6751 Veterans Parkway.
An altercation between Horton and Drago that morning escalated into an alleged assault. Horton is accused of hitting Drago causing him to fall to the ground.
Police reports state that Drago had a fractured skull where he landed on the back of his head on the pavement.
Horton and a friend then got into Horton’s car and left. He was arrested by Russell County authorities Monday morning and extradited to Columbus. His hearing is set for 2 p.m. today.
Drago worked as a deputy with the Lee County Sheriff’s Office from January 2001 to October 2005, Lee County Sheriff Jay Jones said.
