A Russell County Circuit Court judge has ruled in favor of Phenix City Schools in an ongoing legal battle over control of the school board, said Phenix City Schools Superintendent Larry DiChiara.
According to DiChiara, Judge Al Johnson ruled today and granted the board a permanent injunction. DiChiara said that the city is forbidden from removing school board members before their terms expire, interfering in board affairs and demanding board documents.
The city school board filed a Russell County Circuit Court complaint Nov. 22 against Mayor Sonny Coulter and council members Jimmy Wetzel, Max Wilkes, Michelle Walker and Arthur Sumbry. The motion sought an order restraining them from removing anyone on the school board or otherwise injecting themselves into school district affairs.
The court filing followed city council votes this year to remove board members, direct the board to meet with city leaders, and subpoena school district information.
