Michael Marshall claims he had good reason to violate a stay-away order filed by his former girlfriend: the Iron Bowl.
The 48-year-old, originally jailed on Nov. 13 for DUI and other traffic related charges, was court-ordered to refrain from contacting his 51-year-old former girlfriend until November 2014. But Nov. 30's game, in which Auburn University was victorious over University of Alabama, prompted him to phone from Muscogee County Jail.
He was charged with stalking following the call.
"I just called to say 'War Eagle.' It was an incredible game," Marshall said Thursday during a Recorder's Court hearing, his voice shaking. "Sweetheart, I love you and I miss you. I wasn't doing it to be mean. I thought it was a nice call."
Judge Michael Cielinski set Marshall's bond at $5,000 with conditions.
