Having a neighbor is typically a positive experience because neighbors help each other out and keep one another company. However, occasionally, a disagreement may arise, making things awkward on the street.

Something as little as your neighbor putting their trash in your garbage can create a quarrel.

And if it keeps happening, you may start to wonder if it is actually legal or not. So, let’s take a look:

Is it legal for my GA neighbor to put their trash in my garbage can?

Technically, there is no law prohibiting a neighbor from putting their trash in your garbage can, but it is frowned upon.

“Sneaking trash into a neighbor’s bin is always a hard no. It’s a rude act that may violate your neighbor’s trust,” according to experts with The Spruce blog.

However, it could be illegal under the “illegal dumping” law in Georgia. The law says it is “unlawful for any person to intentionally dump egregious litter… in or on any private property, unless prior consent of the owner has been given.”

So, if your neighbor does this and you haven’t given them permission to do so, it could be categorized as ‘illegal dumping.”

There could also be “theft of services” for using your garbage service without your permission or even trespassing penalties if your neighbor keeps doing this, too.

So, what can you do to make your neighbor stop doing this if they keep it up?

According to House Digest, here are some tips:

  • Have a non-confrontational conversation with your neighbor
  • Kindly communicate your boundaries
  • Move the garbage can closer to your home and label it with your last name on both sides. Take it to the curb before pickup and back to your house after.
  • If they keep doing this, you could report them for trespassing and/or theft of services for using your paid garbage service
