Whitaker says his client not at murder scene

Kevin Johnson, Xavier Reynolds and Marcus Brown made their appearance in Recorder's Court this morning and all three were held over to Superior Court for the February 2006 murder of Balwant Lal.

Brown and Reynolds have told police that Johnson, who was only 15 at the time of the shooting at Pyramid Food Mart on Buena Vista Road, did the shooting but Johnson's attorney Alfonza Whitaker said nothing could be further from the truth. When the crime occurred, Whitaker said, "my client didn't even those the other men. He met them three months later."

Whitaker said that Brown, who was already in jail awating trial for armed robbery and burglary charges, thought he could help himself by giving police something they wanted, in this case, a solved murder.

"His plan," said Whitaker, "backfired."
