James A. Summers, 25, was indicted by a Muscogee County grand jury on Tuesday of cruelty to children and sexual battery.
Summers, who is out on bond, is accused of inappropriately touching two boys under 16 years old on May 19, 2009. A girl under 18 years old allegedly saw the touching, the indictment states.
Summers faces two counts of first-degree cruelty to children, two counts of sexual battery and one count of third-degree cruelty to children.Someone convicted of first-degree cruelty to children faces five to 20 years in prison while prison time for a third-degree offense is capped at a year.
A conviction on a count of sexual battery warrants one to five years in prison.
