A Muscogee County grand jury dismissed this week the case against a man accused of assaulting his girlfriend by grabbing her neck and holding her down until she couldn’t breathe, court records state.
Timothy Lee Clark, 31, faced charges of aggravated assault, obstruction of a 911 call and criminal trespass, reports state.
According to police, Clark was at his girlfriend’s Hawthorne Drive home in April when he became angry and started cursing at her. She told him to leave, but instead he allegedly grabbed her throat and held her down on a couch.
The woman couldn’t breathe, and she kicked Clark in the groin to escape. She was about to call police when Clark allegedly grabbed her cell phone and threw it against the wall, police said.

Police say they arrested Clark hours later at his Avondale Road home.
