12-year-old mishandled stolen gun, accidentally killed man, LaGrange police say

The LaGrange Police Department arrested a 12-year-old boy who is charged with manslaughter and possession of a firearm while under the age of 18.

Related to the same incident, LPD also announced the arrest of Azion Avery, 19, who is charged with making false statements, furnishing a firearm to a minor, reckless conduct, theft by receiving a stolen firearm and felony involuntary manslaughter.

On March 25, at approximately 8:45 p.m., LaGrange police officers responded to North Cary Street in reference to a person who had been shot.

After officers arrived, they found a man, identified as Nyquarious Gates, who had sustained a gunshot wound to his body, according to LPD’s news release.

Gates was transported to WellStar West Georgia Medical Center, where he died as a result of his injury, police said.

“The investigation revealed that a 12-year-old male juvenile was mishandling a loaded firearm when it discharged, striking the victim,” the news release says. “The juvenile was taken into custody and detained.”

On March 27, LaGrange police detectives determined the firearm used in the incident belonged to Avery, according to LPD.

“Avery was at the location at the time of the incident,” the news release says. “It was determined through Avery’s negligent actions that the minor came into possession of and mishandled the firearm, leading to the death of Nyquarious Gates. The firearm was recovered, and further investigation revealed that the gun was reported to have been stolen. Avery was taken into custody and was transported to the Troup County Jail.
